Just b/c people have been going down those trails for years, doesn't mean they weren't breaking the law too. Other people may have been stopped and warned or ticketed but didn't tell anyone. Just b/c noone else has ever been caught doesn't make it any more legal and not against the law.

Not to be a total douche bag to my fellow boys in blue and to there state laws, and of course not saying that Ive ever done this sort of stuff before.....right Andeazy?!....but MN State Statute 609.605 Sub.1(v)(A) It states that in order for property, regardless of whether or not its a construction site, school, hospital, bank, park, farm field or sand pit, it must have the placement of a sign at least 11 inches square in a conspiuous place on the property and two signs for every 10 acres being protected. Now there is a trick to "Trespass" law in MN.....dependant upon the location of the property.... now if there is a gate/fence regardless of size that would make one resonably believe that it is private property, well then your screwed....Also FYI under MSS 609.6055 Sub.3, if your property is a pipeline or criticaly important piece of property, ie. pipeline, haz. mat. facility, oil refinery, ect., then you must post your property every 500 feet.

^ Point of order, I am 99% sure that is Foot traffic only, I don't think you could go off roading in my Backyard because it isn't posted. I think it is more for hunters than anything else. And are state is really Lax on Private Property Rights, in south Dakota for instance you can't be on private land period without written permission, wehter posted or not. The nice part about SD is you can hunt Right of way's though (Road ditches) but you can't in MN

~HJ

P.S. Here is the DNR's explination of trespass laws in MN in Laymans terms. It says foot traffic. Scroll down to exceptions.

http://files.dnr.state.mn.us/rlp/reg...sing%20laws%22

And on Page 25 It states that un posted Private land is still off limits.

i found out that the reason the cop had stopped us was to make sure we were doing drugs or anything of that sort. i talked to one of my buddies who is a cop in that area and he said that they occasionally check down there to make sure that no one is smoking weed or anything since its so far off the main road. and as far as i know, the road isnt set up for offroad. the land is idle. there is no type of contruction or anything going on and i dont think there ever has been.

hazzard i agree with the whole lawsuit bit, but i feel if you get hurt doing something else thats your own fault. too bad there is too many greedy people out there.

Jay and I am not calling you a punk but please do not tell me you are a good person just b/c your pop is a cop and that you are a law major.... Most kids of cops are the worst b/c they think they are invincible (which unfortunately most are! LOL).
Whether it is posted or wether everyone else does it does not make it right. Now me personally.... I am not going to go chase anyone in the woods unless I get a call or complaint about it... WHY? B/c I get 25 calls to handle in 12 hours and do not need to be wasting it chasing kids in the woods. HELL if I did get a call I would have prob arrested you and your friend just b/c you are wasting all our time chasing someone through a place they should prob not be in the first place.... And now other real emergencies are getting backed up.
And honestly.. You can say you have never heard of anyone ever driving there and getting stopped? Most places people know they should not be, I know that I was not born yesterday.. (most of the time when you find the place it goes like this... "Yeah we found this cool spot to wheel, just watch for the cops b/c they hassel you if they see you!" They just choose to take their chances...

I myself used to wheel at a spot in NJ that the police even said it was ok... As soon as I heard otherwise I stopped.. Why? B/c I would then be the person that helps to get these spots closed due to abuse.

unfortunitly your right about the whole cops sons thing. im going to be 20 soon and have been drive for about 4 years, ive never been pulled over, arrested or anything. i did get a loitering ticket once for hangout at a car meet which got dismissed in court. the only reason i said that is i feel that their are some people on this forum that are a little too quick to judge people. and it gets me pretty angry. like more than half the people who replyed to this topic, been then and done that. we learn from are mistakes dont we? i didnt get a ticket or my truck impounded, so i guess you can call me lucky. end of story.

by the way where in jersey did u used to wheel?

It was probably some local sand pit, next to an old landfill, where you drive down this wooded road for 2 miles and then the trails are just at the end, and there were no trespassing signs......

Oh wait a min....

lol j/k doc

Dont listen to them man, if they have never pulled into private property or wheeled somewhere theyve never been then they are just little angels....and if they did they didnt tell everyone but still...

Ive had my times one my ATV and in my truck where i was on some abandoned property and the cops came....Some private property is "UNFIT TO BUILD" as the place right down the street from my house is, but until recently do the cops come....

But dont listen to them, They are all goody goods...

36 posts on this....damn....that's a lot of BS to read....LOL

Wheeling is always fun, and sand pits are always a blast....but getting caught just sucks, and getting a ticked just flat out blows.

You live, you learn.....end of story. I just like how there are so many "I can't believe you did that" people in here......not like no one has ever done something wrong in here before.

The guy was telling his story, he wasn't bragging about anything or shooting down cops like so many others do.

So just let the posts go there kiddies.......tomorrow is another day!!! LOL

I have never wheeled anywhere that I knew was illegal or private property. If I wheeled a spot and later found out that it was not legal (Ft Mott) then I never went back. That's what's called being a responsible 4-wheeler. Some of us behave responsibly because we are aware of the consequences of being irresponsible. Less places to wheel legally. Some of us are obviously a little older and a bit more mature than others as well...

Call me a goody goody all you want, but it's simply doing the right thing. I know that when the state of NJ decides to make the over 150,000 acres of trails in the state illegal to drive on, that I wasn't at all part of why it happened. I do what I can to keep the legal spots open and you do what you can to cast a negative shadow on offroaders and get the legal spots shut down. Which side do you want to be on?? Oh yeah, your dad will get you out of trouble so you don't care which side you're on.
