Thats why your rates went up, Uninsured motorist, Like on my policy If I get into a wreck and the person is uninsured and they skip, my insurence company will pay to fix my truck(sounds like you had this coverage) now is where it gets tricky. In that situation it was filled on your insurence, which will count as a claim against you since they had to pay money. Now they are supose to go to court and file against the person whom hit you and if they ever surface they will get them. This happened to a coworker a few months ago he had to pay for everything, but they cuaght her about a month later she was arrested and had to Re-pay hi deductable but his rates still went up.
Now if thats the case with OP yes his rates will go up, but typicly if the driver is insured thats at fualt you file on theres so yours wont rise, if they try and file on yours normally the insurence company will handle it if not you need to layer up and make them take care of it.

thats right. i was rear ended once then i had a guy run a red light and i t-boned him super hard in my lexus, both not my fault at all. my rates never went up and i didnt have to pay my deductable or rental, insurance covered everything
