It certainly does matter, It does not get filled on your insurence if your not at fualt, you file on the other drivers becuase they cuased the wreck to begin with, your not a risk becuase you didn't cuase the Wreck to begin. If it does you got screwed you need to get a lawyer to handle what your insurence company could not.
I know becuase I have been in 2 wrecks both of which where not my fualt, both of which the other drivers were given citations, Both of which my insurence company where going to go to court in my defense, Becuase I was not at fualt. My rates have done nothing but go down since then.
Completely unrelated sidenote : When did you get the plate bumper for your Truck it looks completely BA

Im just going by what happened to me when I got rear ended in my first truck back in high school. i also got hit in a parking lot while the truck was parked and I wasnt even in it.
My insurance went up from those incidents even though neither was my fault, hell my truck was parked in the parking lot!
anyway, im not an insurance agent, but maybe it depends on whos insurance pays for it... the guy that rear ended me didnt have insurance. My insurance co. was supposed to sue him or something, but at any rate it was my insurance that initially paid to fix it. same with the parking lot wreck... the *** that hit my truck didnt leave any info.

Thats why your rates went up, Uninsured motorist, Like on my policy If I get into a wreck and the person is uninsured and they skip, my insurence company will pay to fix my truck(sounds like you had this coverage) now is where it gets tricky. In that situation it was filled on your insurence, which will count as a claim against you since they had to pay money. Now they are supose to go to court and file against the person whom hit you and if they ever surface they will get them. This happened to a coworker a few months ago he had to pay for everything, but they cuaght her about a month later she was arrested and had to Re-pay hi deductable but his rates still went up.
Now if thats the case with OP yes his rates will go up, but typicly if the driver is insured thats at fualt you file on theres so yours wont rise, if they try and file on yours normally the insurence company will handle it if not you need to layer up and make them take care of it.
