nate_g_2003 08-18-2009 10:54 PM

Take it to a dealership and have them fix it and bill the other dude's insurance lol.

Sucks to hear man. Good luck with getting it taken care of.

TXRanger09 08-18-2009 10:58 PM

dealership? wouldnt they just send it out to a body shop? and i will have more pics as soon as my crapberry storm stops being stupid and its dark here in the dessert so the flash would pry glare to much

Rolldogg 08-19-2009 07:16 AM

So that's what's inside the mirrors........

Sorry to hear about that. At least you chased the non-English speaking prick down. I know most of us would have probably done something stupid, but it sounded like you kept your cool and let the professionals deal with it.

TXRanger09 08-19-2009 06:32 PM

ok so now their insurance guy came by and said they arnt paying for it because in their report from yesterday their was no dents and crease wich u can plainly see in the pic so i went to jag and they are referring me to a lawyer off base. took it to the ford dealer here Casa Ford and they said 631 to fix it and 287 for a rental car so if any of yall are lawyers in tx and want to help for free thanks ...im not trying to be a dick to these people all i want is my truck fixed.

RobP 08-19-2009 07:33 PM

File a complaint with the state board of insurance, and give as many details and names as possible. Point out that the insurance company is forcing you to file suit against both the driver and his company in order to get your truck fixed. Include the pictures of the damage. The insurance company is forced to answer this complaint, and the insurance board will follow up with you to verify it was handled to your satisfaction.

When my beloved SHO got totaled by a guy of middle eastern origin, I used this tactic and came out all right. I also sent copies of my complaint to the CEO and chairman of the board and every other relevant manager of the insurance company that I could find. About three days after I mailed my complaint, a regional claims manager called me and I pretty much got what I wanted.

And yeah, it was the Texas state board or insurance. Don't have the address handy, but you've got a computer and Google is your friend.

TXRanger09 08-19-2009 07:48 PM

ok tomorrows gona be busy i just want it fixed why do people try to do this . i know im young and my first accident but wtf Thanks Rob P

nikkistang90 08-19-2009 08:00 PM

i know how that it is i have a 08 that had 5000 miles on it and someone ran down the hole side of my truck 8000 dollars and twoand a half months later i get it back good as new but what a pain in the ass it was to get fixed.

TXRanger09 08-19-2009 09:21 PM

yep i have only had it a month made my first payment yesterday too and i already have 5100 miles going back and fourth between el paso and abilene to see my wife every weekend.

RobP 08-19-2009 11:06 PM

Yeah, it sucks that your new truck got bent. If you have to, you can use your insurance company to fix your truck, but you'll be out your deductible. Then they'll subrogate the other guy's insurance company for reparation.

I've had insurance companies try to jack me around twice before, and both times a complaint with the state insurance board got me an equitable settlement. They're required by law to answer those complaints. Insurance companies always use the strategy of giving you low-ball offers and stalling for time, in hopes that you will take whatever they offer, and minimize the $ they have to pay out.

Good luck. At least you can still drive your truck while they dick around.

Semaj82 08-19-2009 11:17 PM

That sucks - brand new truck, and in the right color too...

Yeah - don't rest until the guy's insurance pays for it. That's why his company carries insurance. And it definitely sucks being without a truck - mine in in the shop for body work, and even though I have a loaner, I'm going through serious withdrawal.

Thanks for your service.... gl on the truck.

TXRanger09 08-20-2009 11:48 AM

ok so just had to mention lawyers and their insurance / safty manager called and told me to fax him my quotes and lil paper explaining how it happened and he said in two days i should have an answer but if not monday will be talking to lawyer. im still driving it it just hurts to have a brand new truck that looks like poop. :( o well and you never relize how much u use your mirrors until its gone lol

Bottoms Up 08-20-2009 11:51 AM

It's not enough for them to take our ****ing jobs, now they are totaling our trucks. That sucks and I hate to hear this since you just made your first payment. My friend bought a Scion Tc, nice looking car love it. And we worked at Kroger well he still does, and this man in an Oldsmobile Cutlass backed into it, still brand new and drove away from the parking lot not even notifying anyone. I hope it gets fixed and everything turns out ok brother!

Raise hell. They dont have a leg to stand on and you are in the right. Take it to a good shop and get an estimate. I wouldnt go to a DRP if they try to push you there. Go to a dealer if they have an on site shop, or a good shop in the area. Theres no reason your brand new truck should have to look like that. It was their driver's fault, and they have to fix your truck now. Simple as that.

RobP 08-20-2009 12:26 PM

File the complaint against their insurance company. This puts the insurance company on the hook to answer the complaint. "In two day's time" is another stalling tactic. They're screwing you around hoping they can stall long enough and you'll go away. You don't need to be a nice guy about it; they're sure as hell not. You need to get proactive and aggressive.

And don't forget that you have a right to get your truck fixed wherever you want to, not where they tell you to go.

TXRanger09 08-20-2009 08:38 PM

i did go to a dealership here in el paso Casa Ford and they sent me to thier body shop Casa Colision and thats who is going to do it. They told me to get three estimates i said no its a new truck and i want the dealer/ dealers body shop to do the work.

RobP 08-20-2009 09:13 PM

Don't forget that they need to cover a rental car while yours is being fixed, and they also owe you $ for the time you've taken off, etc. to deal with this. Keep an accurate record of all the miles driven, as well as the number of hours you've spent. Don't sign any releases until they cover the whole enchilada.

Bottoms Up 08-20-2009 10:21 PM

Yeah man, cover the whole spectrum. Make sure you are fully REIMBURSED by Chancho and his ****ing company.

a friend pulled up to a stop light in his 1997 cavalier 2 door 5 speed and a school district truck bumped into the friends car pushed the bumper bolts on the truck through the bumper on the friends cavy.. 300 and something to fix it and it was a pain in the ass to squeeze out of the school district..

if it makes you feel better i did this to my truck last winter.. tried to do 4wd donuts in a parking lot with snow+chain link fence pole= big ass dent!!!

Attachment 139993

i fixed this myself as i knew i could do the work and i didnt have the money to take it to a bodyshop... its mostly out now just a little ripple, but maybe one day when i have some cash laying around i'll take it to a bodyshop and let them finish the job.

TXRanger09 08-30-2009 04:57 AM

yeah its been almost two weeks and i got a letter yesterday saying they want another body shop estimate starting to get annoying. going to do that monday then hopefully when i come back from the labor day four day weekend there better be some sort of payment for me in the mail. im on 24 duty right now killed my whole weekend lol 4 more hours counting down luckily the goverment hasnt blocked this site yet :)

03 Army Ranger 08-30-2009 06:58 AM

Man that sucks! I hate stupid people! Don't let em screw you brother!

Newks 08-30-2009 08:04 AM

lol I dono what you are trained in but maybe you have a litle stealth training if ya do just find the people who keep ****ing ya and stick them a few times with an ice pick not enough to kill em just enough to hurt.

RobP 08-30-2009 11:38 AM

They're stalling, and hoping you'll get tired of screwing with them and claim it on your insurance. Or that you'll get transferred or deployed, and go away. They figure you're young and naive, and will do whatever they tell you to do.

You are not required to get another estimate. You are not required to get your truck fixed where they want to fix it. You've dicked around with this way too long. I suggest you try my strategy and file the complaint with the state insurance board. I take it you haven't, since your truck isn't fixed or in the shop yet.

RobP 08-30-2009 11:43 AM

Try https://wwwapps.tdi.state.tx.us/inte...complform.html . In my case, I mailed a detailed letter to the address at the bottom of the form.

Smakes 08-30-2009 12:01 PM

you dont even have to have it fixed at a body shop. you can demand a check instead of paid body work. hell id take it to the ford dealer where its gonna make em hurt. thats what i did when that ****** in the civic slammed into me. fixed my truck for under a grand and pocketed the other 1700
