Just got tagged this weekend

Hi all havent been on in quite some time due to i havent had any problems as such.

anywyas i was sitting at a red light when this 97 escort decided to let his foot of the brake while drinking his coffee and then when is GF scream he hit the gas instead of the brake and hit me in the ****

so now i need to replace the rear bumper but they seem expensive. I aint paying so I dont care but was wondering why they are so expensive

The dealers i have called all 680cdn plus 15 bucks for the brackets.....the rubber pad which i think is ok is another 150 but i dont need that since its not broken .

Insurance companies always take the estimate to include NEW replacement parts. It's up to the body shop if they want to repair any body damage or just replace parts out. Since you're not paying for it, it really doesn't matter too much.
Unfortunatly most insurance companies give the cheque over to the body shop rather then to the customer. Too many people abused the system (for example) taking a $5000 estimate payout from the insurance company, then only spending $1000 to repair the damage, pocketing $4000. I don't know if the same applies down in the US, but here in Canada that's how it normally goes.

In the US, the liable party pays out what the damages are assessed at. There is no law or statute that requires the injured party to use all of the payout, or any portion of it, for repairs to the vehicle. There is no requirement, from that standpoint, that the damages are ever repaired. (obviously, if the vehicle would no longer pass inspection or is otherwise unfit for use on the public roadway, then some repair would be necessary in order to maintain a current registration on the vehicle)

So basically the individual gets a cheque from the insurance company, and if they choose not to do the repairs that were estimated then they just keep the money?

I agree with you there , you gotta ask yourself what the other person would do. do you think they would even hesitate to charge you for brand new parts? more than likely not

had a ford fusion clip my rear end the DAY I GOT MY CRAGARS PUT ON
totally destroyed the rear rim, shredded the tire and just dinged the bed.

i ran it through the guys insurance....got an estimate....and his insurance sent me a check a week later for $700 (i only paid 450 for the whole truck )

used $250 to replace the Cragar (craigslist) and the tire and popped the dent out myself.

it all depends on what you want to do and how you want to do it

glad to see someone agrees

back in 03 i rear ended an 83 s10 that stopped on a freeway onramp for no reason in my moms 91 accord. NO DAMAGE to his truck, accord woulda been totalled but my dad and i fixed all the damage ourselves ....

we exchanged info but agreed no reason to call insruance since no damage to his truck ...

so 2 weeks later he calls my house talkin bout his neck hurts he wants some money, so we report the accident and hes all like we aint gotta do that cause we was supposed to before, nope ca law says if damages less than $700 no req to report ... he never proved his injury so the year statute of limitations went up and its no longer on my record. Woulda been only 1pt cause no damage just an injury.
