Not in Virginia Beach. Local ordinance makes it illegal for people or animals to ride in an open bed. Could be the same in Maine.

I'm pretty sure its anyone older than 16yr is legal in ohio...

That's true, there could be a local ordinance.. but then I'd think that would be awefuly hard to enforce. I've never understood local ordanances like that.. especially when they aren't posted ANYWHERE for visitors to see. How the hell are we supposed to know?! .. But then that isn't the officer's problem, is it?

Just tell the officer to look at title 75 subsection 3719 "Passengers in open trucks"
here is right from the PA Vehicle Code...


(a) General rule. - An open-bed pickup truck or open flatbed
truck may not be driven at a speed of more than 35 miles per hour if
any person is occupying the bed of the truck.

(b) Children. -

(1) Such a truck may not be driven at any speed if a child
less than 18 years of age is occupying the bed of the truck or
trailer.

(2) This subsection shall not apply to:

(i) a child of a farmer who is being transported between
parts of a farm or farms owned or operated by the farmer in order to
perform work on the farm or farms;

(ii) a child possessing a valid hunting license who is being
transported between a hunting camp and a hunting site or between
hunting sites during hunting season;

(iii) a child who is a participant in an officially
sanctioned parade, only during the course of the parade; or

(iv) a child employed to perform farm labor who is being
transported between parts of a farm or farms owned or operated by the
child's employer or employers.

im not absolutely sure... but in ga i had a couple of people in the bed of my truck and stopped in a parking lot and everybody got out. and when they did a popo came out of nowhere and pulled up beside with his lights on. i was like dammit now im gettin a ticket... but he didnt even mention the fact that i had people in thebed of my truck, in fact he didnt even come up to my window or ask for any ID or registration. he just wanted to make sure everything is ok. so i dont know if i dodged a bullet or its not a law in ga. but my cousin did tell me a couple years ago that truck are considered farm vehicles and you dont really have to wear a seatbelt in them if you're over 18. i doubt thats true.

True, but for PA you also have to be seated and over the age of 18 along with the vehicle not exceeding 35 mph.
