It does because if she doesn't take full liability for the accident and my insurance kicks in ...then I have to pay my deductible up front...granted I will get it back, but if her insurance does take full liability, then I pay NOTHING. So yes it does matter.
The other thing is my insurance is going to pain in the ***, being that I have one estimate for 906 dollars and one for 2442.00. Not to mention that the car is only worth 2800.00 and that was on KBB. So what do you think the outcome is going to be?

Well if you take it to a bunch of shops to get estimates have them describe all the work on the invoice.
Some shops (like the $900 one) are gonna do the bare minimum. Some shops go above and beyond and they will replace stuff that doesn't even look damaged like the tire, the wheel, tie rods for that side, the UCA, the LCA, balljoints, bearing, hub, the spindle, new painted fender and emblem even if the old one is salvageable. They just do everything to A. Make money B. Make sure it is completely fixed with no after effects.
There is a shop around here that EVERYONE goes to for estimates and for insurance repairs because they are over the top like that. My mom took here car there when she was rear ended and they estimated like $800 to fix it with a new rear bumper, everything under it, plus paint. We took it to are shop after we got the $800 from insurance and had the bumper repainted for $200. Called it a day. $600 made.

When my 2004 Ranger was smashed by a drunk a few years ago, I went through a similar situation. When it came to appraising my truck I was worried. It was a 60K mile, no option XLT 3.0L Ext Cab 5spd so I wasn't holding out much hope in how it was gonna hold its value.
Well, I know you aren't gonna let them total your car for this mild hit but this still applies. What AAA did instead was they go off of actual cash value when it comes to determining vehicle value. They actually did some research for similar vehicles in the area with similar mileage, options and whatnot and not KBB or Nada.
Most people know that if you could snag a clean Notch for only 2800 that is a steal. So that really isn't a realistic representation of what the car is really worth.
Here in SoCal you won't find a clean Notch for anything less than 4K. A really nice one might be 6-8K. Stock mind you. Stock ones generally go for more out here. Heres an example - http://losangeles.craigslist.org/wst...029690075.html

Little UPDATE guys....well the chick is still Denying the accident. SO my insurance is paying me out. I'm taking the 900$ and adding some money to it, and my whole car is going to get painted. Not telling you guys the color, but keep your eye out for a post. Sourced a LX front clip...just waiting for a call back.. Also sourced some rims...not telling on those either...but YOU will like them.... they are bigger than 16's and they will blind you :)

yeah....I know it does suck. But I'll get it fixed back the way it should be. So no worries. Workin on getting an LX front clip as we speak.

when i got rear ended i didn't call the cops either. the guy was in his 40's, in a new vehicle, with two kids in the car. i got all his info and pics of both cars. started a claim with his insurance who actually sent an adjuster out the next day to look at my truck. got his estimate. took it too my shop who said it was going to cost double what the adjuster said. sent that back to his insurance and got the ok to take it in.
all seemed to be going good but when my shop sent his insurance a bill they denied it! wtf!!!!! i was pissed to say the least. they said the guy who hit me had never let them know what had happened so as far as they were concerned it never happened. Like you I had messages from him claiming he had called.
luckily i know everyone at the shop who fixed my truck and they let me have it back and took all of the evidence i had and they went out of their way to go after him and his insurance company. All was paid at the end thank god and they even gave me $200 for the hassle

Should be getting a check here sometime this coming week. I hope. Going to take that money and a little bit of my own, and go get the whole car painted. Change the bumper/fender's/fender extension's out. Change it back to an LX front end. The way it should be. Got a new set of rims waiting for tire's. So it's going...just not as fast as I want it to happen. But that's ok.
