F-150 Step Tailgate not sitting flush on one side

So I'm going to take a stab and post about my 'new to me' F-150 here because I haven't really found an F-150 forum I wanted to sign up on yet, love the RF family over the years. Per a related post last weekend, I sold Danger Ranger, equipped with machete in the jump seat and all.. I bought a 2015 F-150 Platinum that has the tailgate with the convertible step/pole and it has a factory installed tri-fold tonneau cover which isn't being sealed correctly due too one side of the tailgate not staying depressed. I took the back panel off and I am not sure it has to do with the pole/yellow cap as others have suggested through searching online, so I was going to post a couple images and see if anyone has experience or can recommend things to try before it permanently makes this seal worthless. Pics linked below for better explanation, also noticed I am missing a screw from the tailgate panel/drop in liner (cant seem to find exact match online).

P.S.~ Don't worry I will be getting rid of the drop in liner and getting it LineX'ed in March, the local dealer is booked out until then.
